Heard the parties.
2. The petitioner has been made accused in connection with Special POCSO Case No. 40/2024 arising out of Jama P.S. Case No. 64/2024, for the offences registered under Sections 64 & 303(2) of the B.N.S., 2023, and Section 4 of the POCSO Act, subsequently cognizance has been taken under Section 65(1) of the B.N.S., 2023 and Section 4 of the POCSO Act, pending in the Court of learned A.S.J.-I-cum-Spl. Judge (POCSO), Dumka.
3. On 15.07.2024, the petitioner had intercepted the daughter of the informant in a lonely place and thereafter raped her.
4. Case Diary, earlier called for, has been received. Statements of independent witnesses have been recorded, in which they have stated that the petitioner was only talking to the daughter of the informant. When the informant saw this petitioner talking to her daughter, he was falsely implicated in this case.
5. In view of the aforesaid facts, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned A.S.J.-I-cum-Spl. Judge (POCSO), Dumka in connection with Special POCSO Case No. 40/2024 arising out of Jama P.S. Case No. 64/2024.
