This criminal miscellaneous petition has been filed for restoration of Cr. Revision No. 1260 of 2019 which stood dismissed on account of non-compliance of order dated 02.09.2024 whereby this Court had directed the petitioner to file surrender certificate before 19.09.2024. 3. Learned counsel for the petitioner submits that the petitioner was out of station in search of his livelihood and therefore, he could not surrender. He submits that a supplementary-affidavit has been filed in this case annexing a copy of the surrender certificate dated 11.11.2024. The learned counsel submits that the criminal revision be restored so that the case could be taken up on merits. 4. Learned counsel for the opposite party-State has no serious objection to the prayer for restoration. She submits that the petitioner will have to file the original surrender certificate in the criminal revision records. 5. Considering the aforesaid submissions and being satisfied with the cause shown, the Cr. Revision No. 1260 of 2019 is restored to its original file. The petitioner is directed to file the certified copy of the surrender certificate in the records of the criminal revision. 2 6. Office is directed to place the Cr. Revision No. 1260 of 2019 before appropriate Bench as per roster as soon as the surrender certificate is filed. 7. This criminal miscellaneous petition is accordingly disposed of.
