This is second bail application seeking grant of bail to the Applicant who is in jail since 10.08.2024 in connection with Crime No.240/2024 registered at Police Station Devbhog, District Gariyaband, for the offence punishable under Sections 376(2)(n), 376(3) IPC and Section 4&6 of POCSO Act. 2. The first bail application of the applicant was dismissed as withdrawn with liberty to repeat the same after examination of material witnesses vide order dated 19.12.2024 passed in MCRC No.8089 of 2024. 3. Learned Counsel for the applicant would submit that after passing of the order dated 19.12.2024 the other witnesses PW-2 to PW-5 have 2 been examined, yet trial is not concluded, the applicant is in jail since 10.08.2024 and therefore he is entitled for bail. 4. On the other hand the counsel for the State opposes the bail application. 5. Considering the submissions made by the counsel for the parties, considering the nature of allegation and material collected during investigation and also the fact that when the first bail application was dismissed as withdrawn, the victim was already examined as PW-1 on 04.12.2024, I do not find any change in circumstances or any good ground to release the applicant on bail. 6.
