2. Mr. Gajendra Tripathi, learned Brief Holder, for the State of Uttarakhand/1 to 3.
3. Petitioner has allegedly made a representation to the District Magistrate, Bageshwar on 14.05.2024 regarding the illegal mining over his agricultural fields. The grievance raised by the petitioner is that District Magistrate, Bageshwar has not taken decision on his representation.
4. Learned State Counsel, however, submits that the representation is absolutely silent regarding the persons, who allegedly have mined the petitioner’s agricultural fields.
5. The writ petition is accordingly disposed of by permitting petitioner to make a fresh representation to District Magistrate, Bageshwar. If petitioner makes a representation within two weeks’ from today, District Magistrate, Bageshwar, shall look into the matter and pass necessary orders as per law within four months from the date of receipt of such
representation.
6. It goes without saying that the persons, against whom the allegation of illegal mining is made, shall also be given an opportunity of hearing, while taking the decision.
7. Pending application, if any, also stands
disposed of.
