Complaining illegal construction at premises no.4, Madan Chatterjee Lane, Ward No.41, Borough – V, Kolkata and the failure on the part of the municipal authorities to dispose of the petitioner’s complaint dated 21st May 2025 appearing at page 20 of the writ petition, the instant writ petition has been filed. 2. According the learned advocate representing the private respondent, the construction work carried out is in accordance with the sanctioned building plan. 3. The municipality is represented by Mr. Das learned advocate. By placing before this Court a report dated 2nd September 2025 he 2 would submit that the construction work carried out at the said premises is in accordance with three several reconstruction sanctioned building plans dated 12th September 2022, 31st August 2023 and 17th May 2024 which is for G+IV storeyed residential building. According to the report, the construction was executed under the supervision of Mr. Monojendra Dutta, E.S.E. & L.B.S. Departmental inspection revealed that the reconstructional work is completed in accordance with the sanctioned plan and the same is occupied by the occupants. The report is duly signed amongst others by Executive Engineer(C)Bldg/Br-V dated 2nd September 2025. 4. Having regard to the disclosure made in Court, I am of the view that nothing survives in the writ petition. 5. The writ petition accordingly stands disposed of by retaining the report of the municipality on record. (RAJA BASU CHOWDHURY, J.) R. Bose
