Heard the parties.
The petitioner has been made accused in connection with Sector 12 P.S. Case No. 84 of 2024, for the offence registered under Section 47 (a) of the Excise Act, Sections 25[1(1-A)], 25(1-B) (a), 25(6) and 26/35 of the Arms Act and Sections 111/274/275/292 of BNS, 2023, pending in the court of Ms. Shristi Kumari, learned Judicial Magistrate, 1st class, Bokaro.
On 06.08.2024, co-accused Birendra Prasad @ Biru was apprehended in connection with Harla P.S. Case No.78/2024 relating to murder of one Shankar Rawani. He confessed his guilt and, on his confession, cache of arms and ammunitions were recovered from a godown located at Plot No. 29A, Adarsh Cooperative Colony, Sector 12, Bokaro. Co-accused Birendra Prasad @ Biru further confessed that the godown belonged to this petitioner.
From the paragraphs 38 & 39 of the case diary, it appears that the statement of the owner of the godown and his son has been recorded. The owner of godown namely Banshi Rout has stated that the godown was taken on rent by Birendra Prasad @ Biru.
Learned counsel for the petitioner has submitted that apart from confession of co-accused, there is no material to show that the petitioner was an owner of a godown, from where, cache of arms and ammunitions were recovered.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Ms. Shristi Kumari, learned Judicial Magistrate, 1st class, Bokaro, or her successor, in connection with Sector 12 P.S. Case No. 84 of 2024.
