ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief; ‘‘to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 5 respondent in trying to dispossess the petitioner from his agriculture land in Sy. Learned counsel for the petitioner submits that the petitioner herein is

4 Ac.I.SOOOcents in Sy.No.152/1 situated at Komara Gunta Village HA/VK Vedurukuppam Mandal, Chittoor District having acquired the sanne by way of assignment. Since from the date of assignment, the petitioner has been in peaceful possession and enjoyment of the subject land without there being any interference or hindrance from any quarter. While so, respondent Nos. 2 to 4 are trying to lay road through the petitioner’s land without following due process of law and without issuing any notice to the petitioner. Hence, writ petition. 4. On the other hand, learned Standing Counsel for Gram Panchayat appearing for respondent No.5 furnished written instructions dated 05.08.2025 issued by respondent Nos. 4 and
5. The relevant portion of the said instructions is extracted hereunder:
1. It Is respectfully submitted that the land in Sy. No. 152/1, admeasuring an extent of Ac. 1.30 cents, is classified as D.K.T. (D- Form) patta land, and stands in the name of Smt.G.Munemma, W/o.T.Chandraiah, as per the revenue records maintained in IB Khata No.950. 2. It is further submitted that the official respondent Nos. 1 to 4 have no intention nor any proposal to lay a road in the petitioner’s land. There are no sanctioned works or administrative approvals for laying any road through the said land. 3. In view of the above, it is most humbly prayed that the official respondents 1 to 4 may kindly be excluded from the array of parties in the present writ petition, as no cause of action arises against them. 5

Having regard to the submissions made by the learned counsel for the petitioner and learned Standing Counsel for the respondents and on perusal of the material placed on record along with the written instructions issued by respondent Nos. 4 and 5, it appears that the respondents are not laying any road through the petitioner’s land. Moreover, it is only apprehension on part of the petitioner that the respondents are laying road through the petitioner’s land. It further appears that there is no resolution passed by respondent No.5 for laying of any road through the petitioner’s land as alleged by the petitioner. In view of the clear and categorical statement made by the respondent

4 and 5 through their written instructions, the writ petition is disposed of, directing the respondents, to follow due procedure as contemplated under the law, if at all the respondents intend to lay any road through the petitioner’s land even in the future. Without following due process of law, the respondents are restrained to interfere with the peaceful possession and enjoyment of the subject property of the petitioner.
