--- 07 / 11.02.2025 This appeal is directed against the order dated 04.10.2024, passed by the learned Additional Sessions Judge-I-cum-Special Judge, Gumla in Misc. Cr. Application No. 498 of 2024 arising out of SC/ST Gumla P.S. Case No. 01 of 2024, whereby and wherein, the learned Additional Sessions Judge-I-cum-Special Judge, Gumla rejected the bail application of the appellant.
2. On the pretext of marriage, appellant is alleged to have established consensual physical relationship with the prosecutrix. Later on, he refused to marry her.
3. It appears that the parties were in consensual relationship for five years and thereafter, the present case has been filed.
4. Ms. Supriya Dayal, learned Amicus Curiae appearing on behalf of the Respondent No. 2, has opposed the prayer for bail.
5. Considering the nature of allegation, I am inclined to release the appellant on bail. Accordingly, appellant, above named, is directed to be released on bail, on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, Gumla in connection with SC/ST Gumla P.S. Case No. 01 of 2024.
6. This appeal is allowed and the order dated 04.10.2024, passed by the learned Additional Sessions Judge-I-cum-Special Judge, Gumla in Misc. Cr. Application No. 498 of 2024 arising out of SC/ST Gumla P.S. Case No. 01 of 2024 is set aside.

7. Before, parting, I would like to record my appreciation to Ms. Supriya Dayal, learned Amicus Curiae who has very ably assisted this court during course of hearing of this appeal. The Member Secretary, JHALSA is directed to pay Rs. 5,000/- as remuneration to Ms. Supriya Dayal for her services rendered in this case.
