The petitioner has been made accused in connection with Sarwan P.S. Case No. 49 of 2024, for the offence registered under Sections 363/366/ 376/34 of the Indian Penal Code and Sections 4/6 of POCSO Act, pending in the court of learned Additional Sessions Judge-II-cum-Special Judge, POCSO, Deoghar. Petitioner is alleged to have enticed away the daughter of the informant to leave her lawful guardianship. The statement of the victim has been recorded under Section 164 Cr.P.C., in which, she has stated that the petitioner promised to marry her, due to which, she left her lawful guardianship. She was taken to the house of her brother-in-law, from where, the petitioner had established physical relationship with her. This appears to be a case of adolescent love affair between the parties. In view of the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, POCSO, Deoghar, in connection with Sarwan P.S.
