The present petition filed under Article 226 of the Constitution is directed against the decision of the Competent Authority whereby, the request of the petitioner to grant licence for building stone quarry business in Sy.No.63 at Mayasandra Village, Devanahalli Taluka, Bengaluru Rural District came to be rejected on the ground that the application was for the area of 0.20 guntas only whereas the minimum area to be applied was 2 Acres. 2. In course of the conduct of the petition, it was not possible for learned advocate to come out from the rigor of the provision that it is only if the application is for minimum 2 Acres of land, the same can be considered for building quarry lease. 3. Learned advocate Mr.
Ramachandra Halilnathota for the petitioner however, submitted that now the petitioner intends to make a fresh application applying the quarry lease in respect of 2 Acres of land. - 4 -

4. The petitioner is permitted to make such application which shall be considered in accordance with law and on its merits.
