The Court made the following Common Order:
Learned counsel for the revision petitioner is present.
2. Notice was taken out on respondent/J.Dr and was returned unserved with postal endorsement and the addressee has been absent all these days. In such circumstances, service is held sufficient. None entered appearance.
3. In O.S.No.98 of 2007, a money decree was passed in the year 2007 and the J.Dr did not discharge the debt amount. The D.Hr had filed E.P.No.4/2010 on the file of Principal Junior Civil Judge, Avanigadda seeking arrest and detention of the J.Dr in civil prison. The E.P.No.4/2020 was dismissed on the ground that the D.Hr miserably failed to prove that the J.Dr was having financial capacity to discharge the debt amount.
4. Aggrieved by the order passed in E.P.No.4/2010 in O.S.No.98 of 2007 dated 21.01.2013 passed by the learned Principal Junior Civil Judge, Avanigadda, the present revision is

filed and in that process there occurred 36 days delay. Seeking condonation of it, this petition is filed.
5. After hearing the submissions of learned counsel for the petitioner, it is seen that there was delay in establishing contact between the petitioner and his counsel on such facts, this Court finds that the cause urged by the appellant/petitioner is not satisfactory.
6. While granting liberty to D.Hr to explore his remedies in execution of the decree before the Court below, C.R.P.M.P.No.14103 of 2013 is dismissed.
Consequently, the C.R.P.(SR) No.14103 of 2013 stands rejected being barred by limitation.
