The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita, has been filed to quash the impugned order dated 31.08.2024 passed by Additional Chief Judicial Magistrate, Court No. 6, Mordadbad in Case No. 30097 of 2021, (State Vs. Alok Kumar Mishra and others) arising out of Case Crime No. 1277 of 2020, under Sections 323, 504, 506 of I.P.C., whereby the application dismissed the discharge application of the applicant. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
