Heard learned counsels for the parties.

The instant writ application has been preferred by the Petitioner praying therein for the following reliefs: A. To issue direction to the respondent authorities to consider promotion of the petitioner, who has been an Inspector of Police since 06.01.2004, to the post of Deputy Superintendent of Police with effect from the date of promotion of his junior Inspector of Police, Mr. Manoj Kumar Rai (promoted in 2006), as the legal impediments i.e. the effect of two punishment orders dated 06.02.2013 (Annexure-2 Series) for making the promotion of the petitioner at the time of promotion of his junior has been set aside by the Appellate Authority on 05.03.2014 and 04.03.2014 (Annexure-3 Series), B. To, issue further direction upon the respondent authorities that, if as of now there was no legal impediment as on 25th June, 2013 in granting promotion of the petitioner to the post of the Deputy Inspector of Police, the petitioner be granted promotion to the said post from that date of promotion of his junior with all the consequential benefits including salary as well as seniority etc, as because a junior to the petitioner has been granted promotion to the said post with all the consequential benefits.

Learned counsel for the petitioner submits that though
2025:JHHC:14996 2 the Petitioner is fully entitled for the prayer made in the instant writ application; however, in spite of repeated representations, the grievance of the Petitioner has not yet been redressed.

Learned counsel for the respondents fairly submits that since no counter affidavit has been filed; as such, the Petitioner may be directed to approach the respondent No.1 to look into the matter so that if the case of the Petitioner would be found suitable, he would pass appropriate orders.

Having regard to the aforesaid submissions, without going into the merits of the case, the instant writ application is hereby disposed of by directing the respondent No.1 to look into the grievance of the Petitioner by treating this writ application as representation and pass a reasoned and speaking order in accordance with law and applicable Rules and Regulations and communicate the same to the Petitioner and if the case of the Petitioner is found suitable, necessary order of promotion be issued forthwith. The petitioner shall submit the copy of this writ application to the respondent no.1 at the earliest so that his grievance can be addressed soon
It goes without saying that the entire process shall be completed within a period of 12 weeks from the date of receipt/production of copy of this order.

With the aforesaid observations and directions, the instant writ application stands disposed of. Pending I.A., if any, also stands closed.
