t 3 THE HONOURABLE SMT JUSTICE KIRANMAYEE MANDAVA WRIT PETITION NO: 20925 OF 2025 The Court made the following order: The writ petition is filed assailing the proceedings of the 5^^ respondent dated 24.07.2025, by which, in order to resolve the disputes between two rival groups of the management committee, a meeting was convened to constitute an ad-hoc executive committee. 3. It is contended that the 1 association under the provisions of The Andhra Pradesh Societies nd petitioner was elected as president of the 1 Registration Act, 2001. The 2 petitioner association on 10.04.2025. In the earlier round of litigation, challenging the inaction on the part of the respondents on the complaint made against the 2^^ petitioner herein a writ petition in W.P.No.8136 of 2025 was filed. In the said writ petition, the written instructions of 5*^^ respondent in the case were placed on record. It is relevant to refer to the said written instructions. The same are as follows;
4. “To provide amenities to the devotees visiting for the darshan of Sri Bhramaramba Mallikarjuna Swamy, the
4 ■4v Government of Andhra Pradesh has issued orders to allocate land for the construction of Annadanam Satrams in Srisailam. /As part of this, the Srisaila Devasthanam has Ac. 0.50 cents of land in Srisailam temple area to Akhila Bharatha Srisaila Kshetra Vadiyarajula Satram, Srisailam. allocated This office has received number of complaints, regarding non conduct mis management, non production of accounts, of annual audit, etc., against the Akhila Bharatha Srisaila kshetra Vadiyarajula Satram, Srisailam. Accordingly, a notice of enquiry has been issued to the Committee of Akhila Bharatha Srisaila kshetra Satram, Srisailam to attend 17.01.2025 along with the connected records. However, the committee of the Akhila Bharatha Kshetra Vadiyarajula Satram have requested that may be conducted on 05.02.2025. Vadiyarajula an inquiry on 07.01.2025 and Srisailla the inquiry As per the request of the Satram Committee, the inquiry was scheduled on 05.02.2025, and this w/as also communicated to P. Srinivasulu, T.Srinivasulu who Writ Petitioners and the Management Bharatha Srisaila Kshetra Vadiyarajula Satram. were the committee of Akhila Meanwhile, on 04.02.2025, Sri J. Ramutu, the Chairman, Mahashivaratrl which informed this Bhramotsavams office that due to are scheduled on 26.02.2025, involves serving of Annadanam to thousands of devotees. and due to his personal health reasons, they would not be able to attend the inquiry scheduled on 05.02.2025. The chairman has also further informed that a General Body
Meeting would be held, and regular elections to the chowitry committee would be conducted on 10.04.2025.
Further, it is submitted that, as part of the internal disputes over the management of the Satram both the parties have filed complaints against each another. As the enquiry could not be concluded and reasonable
order is not passed filling of the present writ petition is nothing but premature one without exhausting balance of the present writ petition is filed and the convenience, authority has to verify the entire record pertains to the chowitry, and the existing committee has to produce three years annual audit reports along with general body meeting minutes before the Executive Officer, Sri Bhramaramba Mallikarjuna Swamy Varla Devasthanam to arrive whether the existing committee is functioning properly or not and after perusal of the entire record with receipts and expenditure this authority cannot arrive a logical conclusion and to pass reasonable orders in this regard. That was not done in the instant case and directly approached the Hon'ble Court which is premature in nature and the writ petition is not maintainable and liable to be dismissed with costs. ’’
5. The said writ petition was disposed recording the submission made on behalf of the respondents that enquiry was initiated pursuant to the complaint petitioner herein. The respondents were directed to complete the enquiry within two months from the date of receipt of the order. nd received against the 2

Liberty is granted to the 5 IS set respondent to pass appropriate orders pursuant to the enquiry initiated vide notices dated 07.01.2025, 17.01.2025, by the petitioners and and 10.07.2025, after considering the explanation filed after giving due opportunity of hearing to the petitioners, Within a period of four weeks from the date of receipt of a copy of this order. It is needless to observe that the petitioners shall cooperate with the enquiry initiated by the 5*^ respondent.
The b'" respondent shall issue and serve notice of hearing to the petitioners and the petitioners shall appear before the 5*'' respondent without petitioners fail to appear despite the respondent is at liberty to fail on the date thus scheduled.
