Heard Mr. R. Ali, learned counsel appearing for the petitioners. Also heard Mr. B. Sharma, learned Additional Public Prosecutor, Assam. By this application filed under Section 482 of the BNSS, 2023, the petitioners, namely, (1) Abdul Khaleque and (2) Feddus Ali Ahmed, who apprehend arrest in connection with Garchuk P.S. Case No. 194/2025, have prayed for pre-arrest bail. By producing the Case Diary, the learned Additional Public Prosecutor has submitted that pursuant to the interim order dated 17.07.2025 passed by this Court, the petitioners have appeared before the Investigating Officer and their statements have also been recorded. Having heard the learned counsel for both the sides, this court is of the opinion that, as the petitioners have been appeared before the Investigating Officer and cooperating with the investigation, the custodial interrogation of the petitioners is not necessary. Hence, the prayer for pre-arrest bail of the petitioners is allowed. Accordingly, the interim order dated 17.07.2025 passed by this Court is made absolute. The bail application is disposed of.
