ORAL ORDER
Accused No.1 in Crime No.55/2025 registered by Subramanyanagar Police Station, Bengaluru, for the offences punishable under Sections 126(2), 115(2), 109(1), 352 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS') is before this Court in this successive bail application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS'), seeking regular bail. 2. Heard learned counsel for the parties. 3. FIR in Crime No.55/2025 was registered by Subramanyanagar Police Station, Bengaluru for the aforesaid offences against the petitioner herein and two others based on the first information dated 12.04.2025 received from the injured Somashekar G. During the course of investigation, petitioner herein was arrested on 13.04.2025 and subsequently, remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.3466/2025 was rejected on 03.05.2025. Therefore, he is before this Court. - 3 -

Perusal of the FIR on record would go to show that the injured and accused No.2 Naveen had faught against each other and injured victim allegedly had assaulted Naveen with his hands on the said date. It is in this background on 12.04.2025 Naveen, who came along with the petitioner herein allegedly after abusing the injured Somashekar G. had assaulted him. The allegation of assaulting Somashekar G. with a weapon is as against the petitioner who is arrayed as accused No.1 in the FIR. During the course of investigation, accused Nos.1 and 2 were arrested on 13.04.2025. Accused No.2 has been granted regular bail by this Court in Crl.P. No.6973/2025 which is disposed of on 18.06.2025. Investigation of the case is now completed and charge sheet has been filed. 5. Undisputedly the petitioner has no other criminal antecedents. The injured victim who was admitted in hospital was subsequently discharged and his condition is said to be stable. Under the circumstances, I am of the opinion that without expressing any opinion on the merits or demerits of the case, his prayer for grant of bail needs to be answered affirmatively. - 4 -

6. Accordingly, the following;
(i) The petition is allowed.
(ii) The petitioner is directed to be enlarged on bail in in Crime No.55/2025 registered by Subramanyanagar Police Station, Bengaluru, for the offences punishable under Sections 126(2), 115(2), 109(1), 352 read with Section 3(5) of BNS, subject to the following conditions:
(a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties (which includes one local surety) for the likesum, to the satisfaction of the jurisdictional Court;
(b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
(c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

(d) The petitioner shall not involve in similar offences in future;
(e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
