This writ petition has been filed under article 227 of the Constitution of India by the petitioner seeking for the following relief : 10.1 That, this Hon'ble Court may kindly be pleased to set aside the order dated 13.04.2021 (Annexure P/1) passed by respondent No. 4 and further direct the respondent ASHISH TIWARI Digitally signed by ASHISH TIWARI Date: 2025.09.23 10:16:11 +0530 -2- authorities to reinstate the petitioner with all consequential benefits. 10.2. That, this Hon'ble Court may kindly be pleased to direct the respondent No. 2 to decide the appeal of the petitioner dated 05.08.2021. 10.3 That, the Hon'ble Court may kindly be pleased to grant any other relief as it may deems fit and appropriate. 2. Learned counsel for the petitioner submits that vide Annexure P/1, after conduction of Departmental Enquiry, the petitioner was imposed with punishment of termination of services who was working as Assistant Grade- 3 in District Hospital – Baikunthpur, District -Koriya (C.G.), against which the petitioner has filed a statutory appeal before respondent No.2 vide Annexure P/3 in the year 2021. He submits that the statutory filed by the petitioner is still pending for consideration it has not been decided till yet. 3. Learned counsel for the petitioner on instruction submits that the appeal filed by the petitioner is still pending for consideration and it would be decided within a short period of time. 4. After hearing learned counsel for the parties, it is ordered that the respondent No.2 would take the decision on the statutory Annexure P/3 filed by the petitioner within a period of 60 days from the date of receipt of copy of this order, by reasoned and speaking order and communicate the same to the petitioner. If the appeal of the petitioner is decided against him, the petitioner would be at liberty to challenge the same in accordance with law. 5.
