Call for the records and issue a direction to Additional District Judge Aligarh, to decide the Impleadment Application under order 1 rule 10 CPC, paper No. 87-C dated 29.09.2023, filed by the proposed petitioners in Civil Appeal No. 40 of 2018 pending before the Court of Additional District Judge Aligarh, on the next date fixed or within stipulated period as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case. (Annexure No.4);" It is contended that impleadment application under Order 1 Rule 10 CPC (Paper No.87-C), filed in Civil Appeal No.40 of 2018, is pending consideration since 29.09.2023. The sole prayer made in the writ petition is for early disposal of the said application. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon Additional District Judge Aligarh to decide impleadment application under Order 1 Rule 10 CPC (Paper No.87-C), filed in Civil Appeal No.40 of 2018, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of three months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
