THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner has sought for the following relief:- “i. Order in favour of petitioner, by quashing the impugned charge sheet filed and entire proceedings in C.C.No.892 of 2023, pending on the file of the learned Prl. Civil judge and JMFC, Channarayapatna, for the offence punishable under Sections 498A, 506 of IPC read with 3, 4 of Dowry Prohibition Act, at Annexure- C. ii. To grant such other reliefs as deemed fit under the circumstances of the case in the interest of justice and equity.” 2. Learned counsel for the petitioner – accused No.1 and learned counsel for 2nd respondent – complainant have filed a Memorandum of the settlement by way of joint affidavit duly signed by the petitioner, 2nd respondent and their respective counsel and the same is taken on record. - 3 - HC-KAR NC: 2025:KHC:20673 CRL.P No. 7639 of 2024 3. Petitioner – accused No.1, respondent No.2 and their counsel are physically present before the Court and they admit the contents of the Joint Affidavit, which reads as under:- “MEMORANDUAM OF THE SETTLMENT BY WAY OF JOINT AFFIDAVIT FILED BY THE PETITIONER AND RESPONDENT NO.2 We Shri. Prasanna Kumar M.S S/o Late. Siddaiah, aged about ) 35 Years, R/o: 4th Cross Siddharth Nagar, Maddur City, Mandya District-571429, the Petitioner herein AND Smt. Sangeeta C.S. W/o. Shri. Prasanna Kumar M.S, aged about 33 years R/o:2nd main road Gayathri Badavane, Nagasamudra Road, Channrayapatna Town, Hassan District-573116 the Respondent No.2, herein the above caption matter do hereby solemnly affirms and begs to state on oath as follows:- 1. Whereas, the marriage between the Petitioner- and Respondent was solemnized as per Hindu rites and customs on 01/07/2018. 2. We are aware of the facts and circumstance of the present case and accordingly we are swearing to this affidavit. 3. That we have settled the matter outside the Court with the intervention of the elders of our family and By signing this affidavit the parties here to solemnly state and - 4 - HC-KAR NC: 2025:KHC:20673 CRL.P No. 7639 of 2024 affirm that they have no further claims or demands against each other. 4. In view of the terms of this settlement- agreement, both the parties herein undertake to withdraw all the pending cases against each other before any court of law or any other forum which are as mentioned below including this petition: i. Criminal Misc.546 of 2023 filed by the Respondent No.2 which is pending before the Senior Civil Judge Channarayapatna. ii. Matrimonial Case:-129 of 2024 filed by the Petitioner which is pending before the senior civil judge Channarayapatna. iii. G and WC case: 24 of 2023 filed by the Petitioner which is pending before the senior civil judge Patna. Channaraya 5. We are also jointly say that the respondent wife has joined conjugal society of the husband petitioner at Bengaluru along with their only son closed and we are leading happy life hence the Petition May be closed in the ends of justice and Equity. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Affidavit dated 16.06.2025. (ii) The proceedings in C.C.No.892/2023 (arising out of Crime No.62/2023 of 1st respondent – Police) registered for the offences punishable under Sections 498A, 506 of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961 pending on the file of Principal Civil Judge and JMFC, Channarayapatna, insofar as the petitioner is concerned are hereby quashed.
