1. Heard Ms. Shreya Soni, learned advocate for the applicant and Mr. Harsh Joshi, learned advocate has entered his appearance on behalf of respondent no.2 and Ms. Esha Bhavsar, learned advocate has entered her appearance on behalf of respondent no.1. The notice issued by this Court was duly served upon the respondent no,3, however respondent no.3 has not chosen to enter his appearance. Noticing the number of days involved, application seeking condonation of delay of 83 days is taken up for hearing in absence of respondent nos. 3.
2. Present application is filed under Section 5 of the Limitation Act read with Section 173(1) of the Motor Vehicles Act, 1988 to condone the delay of 83 days caused in preferring the First Appeal.

3. Considering the averments made in the application and
submissions made by the learned advocate for the applicant and in absence of any objection being raised by the contesting respondents, looking to the controversy involved, the delay of 83 days caused in preferring the appeal is hereby condoned. Present Civil Application stands allowed to the aforesaid extent.
4. Registry is directed to reflect the name of Mr. Harsh Joshi, learned advocate for respondent no.2 and Ms. Esha Bhavsar, learned advocate for respondent no.1 in the First Appeal.
