IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 9765 of 2024 Subham Kumar @ Subham Kumar Ram, aged about 20 years, son of Late Mohan Ram, resident of village Balwa, Dohar, (Power House), P.O: Pratappur, P.S Pratappur, Dist: Chatra … … Petitioner - Versus - The State of Jharkhand ... … Opposite Party ------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH ----- For the Petitioner: M/s. Binod Kr. Dubey, Advocate For the State : M/s. Lily Sahay, A.P.P --- 03/31.01.2025 Heard the Parties. Petitioner has been made an accused in connection with Pratappur P.S. Case No. 80/2024, for the offences registered under Sections 70(2), 137(2) of the B.N.S., 2023 and Section 4 of the POCSO Act, pending in the Court of learned Special Judge POCSO Act, Chatra. It appears that the co-accused Sagar Kumar and present petitioner had taken the victim to the nearby forest. It is alleged that they had attempted to rape her. However, when the victim became unconscious, she was taken to hospital by the petitioner Sagar Kumar. Bail application of the co-accused Sagar kumar, whose case stands on similar footing to that of the petitioner has been earlier rejected by this court. It was submitted that the victim did not raise any alarm when she was taken to the forest. Regard being had to the facts and circumstance of the case; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected. (Ambuj Nath, J.) Saurabh uploaded
