Mr. Suneet Goel, Sr. Advocate, with Mr. vivek Negi, Advocate, for the respondent/applicant. By way of this application, the applicant has prayed for the release of the amount that has been deposited by the petitioner with the Registry of this Court. Learned Senior Counsel for the applicant states that the applicant is willing to furnish bank guarantee to the satisfaction of the learned Registrar General equivalent to the amount to be released and therefore, the application be allowed and the amount be ordered to be released. The application is opposed by the learned Senior Counsel for the non-applicant, who submits that as there is merit in the petition filed under Section 34 of the Arbitration and Conciliation Act and the Objection Petition is likely to succeed in all eventualities in case the amount is ordered to be released, it would be difficult for non- applicant to recover the same. Having heard learned counsel for the parties and having perused the averments made in the application as well as the reply, this Court is of the considered view that interest of justice would be served in case out of the deposited amount of approximating Rs.9,46,00,000/-, an amount of Rs. 5 crores is ordered to be released in favour of the applicant subject to the applicant furnishing bank guarantee of an equivalent amount. Ordered accordingly. The application is disposed of with a direction that let an amount of Rs.5 crores be released in favour of the applicant subject to the applicant furnishing bank guarantee of an equivalent amount to the satisfaction of and verification by the Learned Registrar General of H.P High Court within a period of four weeks from today.
