Pradhan S/o Devilal, Aged About 28 Years, All are R/o Hemda Police Station Sunel District Jhalawar (Raj) (At Present Confined In Sub-District Jail, Bhawani Mandi District Jhalawar (Raj) ----Petitioners Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Rohit Khandelwal, Adv. For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 27/08/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.289/2024, registered at Police Station Sunel, District Jhalawar, for the offence(s) under Sections 189(2), 115(2), 126(2) and 125 of BNS. 2. Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in this case. It is contended that prima facie offence under Section 115(2) of BNS is not made out against the accused-petitioners. The injuries [2025:RJ-JP:34155] (2 of 3) [CRLMB-10775/2025] sustained to injured were not at the vital part and not dangerous to life. It is contended that the other similarly placed co-accused namely- Devilal, Poor Singh, Sagulal and Bhagatram have already been enlarged on bail by the Co-ordinate Bench of this Court. The case of the petitioners is akin to the other co-accused who have already been enlarged on bail, therefore, the bail application of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that injured Kanwarlal, Radhey Shyam, Karoo Lal, and Jagdish sustained several injuries at their body parts. The injured Radhey Shyam has received 5 injuries and out of them one is on the parietal region, which was found to be grievous in nature and his leg was also fractured. Similarly, injured Kanwarlal also received 2 injuries, which was found to be blunt in nature, therefore considering the specific allegations against the petitioners, their bail application may be dismissed. 4. Heard and perused the material available on the record. 5. The other similarly placed co-accused namely- Devilal, Poor Singh, Sagulal and Bhagatram, have already been enlarged on bail by the Co-ordinate Bench of this Court and in the present case, the role of the petitioners are not distinguishable from the other accused who have been enlarged on bail, therefore, considering the above facts, without commenting anything on the merits of the case, this Court deems it proper to enlarge the accused- petitioners on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused petitioners namely; 1. Bherulal S/o Mohanlal, 2. Jagdish S/o Sagulal, 3. [2025:RJ-JP:34155] (3 of 3) [CRLMB-10775/2025] Ramdayal S/o Devilal, 4. Bagdulal S/o Ram Singh and 5. Pradhan S/o Devilal, in connection with FIR No.289/2024, registered at Police Station Sunel, District Jhalawar, shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
