1. Accused in Crime No.69/2025 registered by Turuvekere Police Station, Tumakuru, for the offence punishable under Section 318(4) of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.69/2025 was registered by Turuvekere Police Station, Tumakuru, for the aforesaid offence against petitioner herein based on the first information dated 25.03.2025 received from Ningaraju Y R S/o late Ramaiah. During the course of investigation, petitioner herein was arrested on 28.04.2025 and on the said day, he was remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.10157/2025 was rejected on 19.05.2025. Therefore, he is before this Court. 4. The allegation in the first information is that first informant and the petitioner herein are acquainted to each other and on 20.02.2025, petitioner had allegedly telephoned

the first informant and asked him to arrange an amount of Rs.10 lakhs representing to him that in the event he invests in gold, he would be getting high returns. Believing the petitioner, first informant allegedly invested an amount of Rs.10 lakhs with the petitioner on 27.02.2025 and subsequently, first informant realized that he was cheated by the petitioner and when he tried to contact the petitioner, his phone was switched off and his shop was also found locked. It is in this background, first informant had approached the police .Petitioner is in custody in the present case from 28.04.2025 onwards. FIR has been registered in the present case for the offence punishable under Section 318(4) of BNS, 2023. The maximum punishment for the alleged offence is imprisonment for a period of seven years. Learned HCGP on instructions submits that till date, charge sheet has not been filed in the present case and the same will be filed within a period of one week. Therefore, petitioner is entitled for statutory bail as provided under Section 187(3) of BNSS, 2023. Accordingly, the following order:-
5. The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.69/2025 registered by Turuvekere

Police Station, Tumakuru, for the offence punishable under Section 318(4) of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
