ORDER: This Criminal PetitI'On has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to enlarge the petitI-Oner- accused No. 2 on bail in crime No. 90 of 2024 of Chinturu Police Station, Alluri sI'taraina Raju District, regI'Stered for the Offence Punl-Shable under Section 20 (b) (ii) (c) read with section 8 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution I'S thatOn 04.12.2024 at about 6 plm., opposite to Chinturu Police Station, the Sub Inspector of police found accused No. 1 in possession of 82 K.Gs. of Ganja. Thereafter, the police arrested accused No. 1 and remanded him to J'udiCial Custody. lt iS the further case of prosecution that accused No. 1 was transporting the contraband at the instance of the Present Petitioner-accused No. 2. 3. Sri G.Venkata Reddy,-learned counsel for the petitioner, contends that the petitioner is innocent of the alleged offence and has been f`alsely implicated by the police, no contraband was seized from the possession of the Petitioner and he came to be implicated only on the confession of accused No.

Learned counsel submits that there are no adverse antecedents reported against the.petitioner and he was neI'ther found I'n possession Of the contraband nor spot arrested; that entire investigation is completed and that there are no call details records between accused No. 1 and 2. It is further submitted that the petitioner is the sole earning member of the family and, therefore, his continued incarceration would cause undue harclship to his
3 dependents. The pet[-tioner undertakes to strictly adhere to any conditI|OnS that may be I'mPOSed by this Court. In light of the foregoing, learned counsel prays that the present petitl'on be allowed in the I-nterest of justice. 4. Per confra, Ms. Akhila Naidu, learned Ass['stan{ pubII'C Prosecutor, vehemently opposed the grant of bail to the petitioner, submittl-ng that the investigation I|S Still underway and several material witnesses remaI'n tO be examined and that accused No. 1 transported the GanJ|a at the instance of accused No. 2 and accused No. 2 is the ultimate beneficiary for whom Ganja was purchased and transported. It is contended that if the petitI-Oner js released on baI'I at this stage, there I-s a strong likeII'hOOd that he may abscond, thereby hampering the ongoing invest[|gation and evading the process of law.
ln view of the foregoing, I|t Its urged that the petition be dismissed. 5. Heard learned counsel for the pet]-tI'Oner and learned Ass['stant public Prosecutor. perused the record. 6. On a perusal of the recordJ I-I l'S forthcomI-ng that the petjtjoner was neither in possession of the Ganja at the time of the alleged seizure nor he was sport arrested. Inventory I-S completed. ThI-S Court, by order dated 27-03-2024 ['n Cr[-minaI Petition No. 830 of 2024, enlarged the petitioner on bail by relying on the decisI'On Of the Hon'ble Apex Court in sfafe by IVCBJ

7. The alleged Offence took Place On 04-12-2024. Accused No. 1 was arrested on the spot on the allegation that he was in possession of 82 K.Gs. of Ganja.
Accused No. 1 is owner Of the Vehicle, in Which Ganja was transported. Accused No. 1 gave confession aga'InSt accused No. 2. ln this regard, it is appropriate to refer to the judgment of the Hon'ble Apex Court in p.Krishna Mohan Reddy v. Hence, the chances of the petitioner either tamperI'ng the evidence or threatening the witnesses or hampering the I-nVeStigatiOn may not arise. 7.
Considering the facts and circumstances of the case and the nature and gravity of the allegatI'OnS levelled against the petitioner-accused No. 2 and his period of judicial detention, this court is inclined to .enlarge the petlltiOner- accused No. 2 on bail with the following strl'ngent conditions: (i) The petitioner-accused No. 2 shall be enlarged on bail subject to hI'S executing a bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for the like sum each to the satisfactI-On Of learned JudicI'al First Class Magistrate, Rampachodavaram,I (ill) The petitioner-accused No. 2 shall appear before the station House Officer concerned on every saturday in between 10.loo am and o5:00 pm, {m cognizance Its taken by learned the Trial Court,I
