JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 29-04-2025 Heard learned counsel for the petitioners and the State . 2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 324, 307, 379, 504, 506 and 34 of the Indian Penal Code . 3 . As per the prosecution case , on the alleged date and time of occurrence , while son of informant was going to purchase biscuit from shop , in the meantime , all the accused persons named in the F.I.R., surrounded him and assaulted with lathi and danda . It is further alleged that when brother of informant tried to rescue him, accused persons also assaulted Patna High Court CR. MISC. No.21266 of 2025(2) dt.29-04-2025 2/2 him and also snatched gold chain and Rs. 5,000/- from him. 4. It is submitted on behalf of the petitioners that both parties are gotias and due to pending land dispute a simple occurrence of maarpeet took place between them. Case and counter case . Allegation of assault is general and omnibus against this petitioner. Petitioner claims clean antecedent. 5. Learned counsel for the State oppose the bail petition. 6 Considering the general and omnibus allegation against this petitioner, clean antecedent and circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM Motihari East Champaran in connection with Kalyanpur P.S.
