THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in Crime No.132/2025 registered by Chikkamagaluru Rural Police Station, Chikkamagaluru District for the offences punishable under Sections 8(c), 22(b) of the Narcotic Drugs & Psychotropic Substances Act, 1985 (for short 'NDPS' Act) is before this Court seeking regular bail. 2. Heard the learned counsel appearing for the parties. 3. FIR in Crime No.132/2025 was registered by Chikkamagaluru Rural Police Station, Chikkamagaluru District against the petitioner herein for the aforesaid offences, on the basis of first information dated 14.04.2025 received from Sri Raghunath S.V, Police Sub Inspector, attached to Chikkamagaluru Rural Police - 3 - HC-KAR NC: 2025:KHC:22501 CRL.P No. 7856 of 2025 Station. During the course of investigation, the petitioner who was arrested, produced before the jurisdictional Court and subsequently remanded to judicial custody on 15.04.2025. 4. The bail application filed by the petitioner before the jurisdictional Sessions Court in Crime.No.132/2025 was dismissed on 09.05.2025. Therefore, he is before this Court. 5. Perusal of the material on record would go to show that, based on credible information received by the first informant, the car bearing registration No.KA-03-ME- 7241 was intercepted and the petitioner who was the inmate of the said car was apprehended and from his possession contraband article allegedly MDMA crystal totally weighing 8.37 grams was recovered. Thereafter, apprehended accused and seized contraband article were brought to the Police Station and FIR was registered against the petitioner and subsequently he was produced - 4 - HC-KAR NC: 2025:KHC:22501 CRL.P No. 7856 of 2025 before jurisdiction Court and remanded to judicial custody on 15.04.2025. 6. The seized contraband article was thereafter forwarded to forensic science laboratory for the purpose of examination and report now received from the FSL indicates that, the seized contraband article has tested positive to a drug known as 'Methamphetamine' and 8.37 grams of Methamphetamine is considered as intermediate quantity under the relevant Government notification issued. 7. Undisputedly, the petitioner has no criminal antecedents. He has been arrested and remanded to judicial custody on 15.04.2025. The maximum punishment for the alleged offences is imprisonment for a period of ten years. It is brought to the notice of this Court that charge sheet has not been filed till date in the present case. Under these circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail is required to be answered affirmatively. - 5 - HC-KAR NC: 2025:KHC:22501 CRL.P No. 7856 of 2025 8. Accordingly, the following: ORDER The petitioner is directed to be enlarged on bail in Crime No.132/2025 registered by Chikkamagaluru Rural Police Station, Chikkamagaluru District for the offences punishable under Sections 8(c), 22(b) of the Narcotic Drugs & Psychotropic Substances Act, 1985, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 6 - HC-KAR NC: 2025:KHC:22501 CRL.P No. 7856 of 2025 d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS
