On 25.07.2024, the appellant's counsel stated that despite his best efforts he failed to contact the appellant. Hence, the appeal was dismissed for non-prosecution. Subsequently, an application for re-admission of the appeal was filed which was allowed on 10.01.2025. Thereafter, once again the appellant has not taken steps to complete the service. On 10.01.2025, the appellant was given dasti notice, however, the same has not been returned. Keeping in view the aforesaid facts, last opportunity is granted to the appellant. If the appellant fails to complete the service of the notice upon the respondent within one month, from today, the appeal shall be deemed to have been dismissed for non-prosecution. However, if the steps are taken within the aforesaid period, the office will list the appeal before this court. List, in the urgent list, on 20.03.2025.” Thereafter, on the written request of the appellant, the hearing was adjourned to today. Today again, learned counsel for the appellant shows his helplessness, hence, this Court is left with no choice but to dismiss the appeal for non-prosecution. All the pending miscellaneous applications, if any, are also disposed of.
