This is a petition filed seeking the Court to transfer M.C.No.55/2024 which is pending before the Court of Principal Judge, Family Court, Chikkaballapur to the Family Court, Bengaluru. 3. Learned counsel for the petitioner submits that the petitioner and the respondent are the legally wedded wife and husband. As disputes arouse between them, they are residing separately. The petitioner filed a petition seeking dissolution of marriage on the ground of cruelty and the same is pending before the II Additional Family Court, Bengaluru as M.C.No.2961/2024. After the - 3 - NC: 2025:KHC:1340 CP No. 255 of 2024 petitioner filed such a petition, the respondent also filed a petition seeking divorce vide M.C.No.55/2024 and the same is pending before the Court of Principal Judge, Family Court, Chikkaballapur. Learned counsel submits that as both the cases are out of same set of facts and circumstances, both are required to be tried together. Therefore, the petitioner moved the present petition seeking transfer. 4. The grounds urged remains unopposed. Also the stand taken seeking transfer of the case is justifiable. Therefore, this Court considers desirable to allow the petition as prayed for. 5. Thus the following: ORDER (i) The Petition is allowed. (ii) M.C.No.55/2024 which is pending before the Court of Principal Judge, Family Court, Chikkaballapur is withdrawn and - 4 - NC: 2025:KHC:1340 CP No. 255 of 2024 transferred to the II Additional Family Court, Bengaluru. (iii) The Court of Principal Judge, Family Court, Chikkaballapur is directed to transmit entire records in M.C.No.55/2024 duly indexed to the II Additional Family Court, Bengaluru within a period of one week from the date of receipt of copy of this order.
