Order No.07
Date: 10-03-2025
1. The present writ petition has been filed for issuance of direction upon the concerned respondents particularly the respondent no.3-Circle Officer, Pathalgada, Chatra to issue Land Possession Certificate (L.P.C.) with respect to the land of petitioner appertaining to Khata No. 72, Plot No. 946, measuring an area of 96 decimals situated at Village Dumbi, P.S. Pathalgada, District Chatra.
2. Mr. Zaid Imam, learned AC to S.C-VII appearing on behalf of the respondents refers to para-16 of the counter- affidavit filed on behalf of the respondent nos.2 & 3, which reads as under:
“16. That it is most humbly and respectfully submitted that it is stated and submitted that the agreeing with the recommendation of RSI/CI, the answering respondent legally rejected the Land Possession Certificate of petitioner on 26.09.2024.”
3. As against this, learned counsel for the petitioner submits
2 W.P.(C) No.78 of 2025
that the petitioner’s application for issuance of Land Possession Certificate with respect to the land in question has been rejected by the respondent no.3 in a cryptic manner by putting the note in his application itself.
4. Be that as it may. Since, the petitioner’s application for issuance of Land Possession Certificate with respect to the land in question has already been rejected by the respondent no.3, the aforesaid prayer made in the writ petition has become infructuous.
5. The writ petition is accordingly disposed of. The petitioner is however at liberty to take appropriate recourse(s) as available under law against the order dated 26.09.2024 passed by the respondent no.3.
