The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of BNSS, has been filed by the Petitioner/Accused, seeking quashment of the order dated 09.07.2025 passed by the learned Junior Civil Judge-cum-Judicial Magistrate of First Class, Nandyal in Crl.M.P.No.9 of 2025 in M.C.No.53 of
2024. 2. Heard Sri T.C.Krishnan, learned counsel for the petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing on behalf of the State. 3. Against the impugned order, revision would lie. Such being the case, exercising the powers under Section 482 of the Cr.P.C/under Section 528 of BNSS does not arise.
Learned counsel for the petitioner is permitted to withdraw this petition. 4. Accordingly, the Criminal Petition is dismissed as withdrawn. However, the petitioner is at liberty to file a fresh petition against the impugned order according to law. Registry can return the original certified copies which are filed in this petition to the learned counsel on record on proper identification to enable him to file a revision. 4
