Taking the Court to the paragraph No.41 of the impugned judgment, Mr. Debajit Biswas, learned counsel submits that the learned Trial Court has wrongly appreciated the evidence and dismissed the case on the ground that the complainant did not have the capacity to advance any loan to the accused person. Mr. Raju Datta, learned PP submits that he has no objection if the leave prayer is allowed and matter is taken up on merit for final hearing. Ms. Saswati Nag, learned counsel appearing for respondent No.1, submits that the learned Trial Court was justified in rejecting the case of the complainant and that no perversity has been committed by the learned Trial Court in appreciating the evidence. Considered the submissions. Perused the record. As it appears, the matter is required to be heard on merit. Accordingly, the prayer for leave to appeal is allowed.
