THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Sri E.I. Sanmathi, learned counsel accepts notice for respondent Nos.1 and 2. 2. The petitioner is before this Court seeking for the following reliefs: a) “The Petitioner humbly pray that this Hon'ble Court may be pleased, to issue a Writ of Mandamus or in the nature of Writ of Mandamus directing the 1st Respondent to dispose of the appeals filed for the A.Y.2017-18 (Annexure-B6) and for the A.Y.2019- 20 (Annexure-C6). b) This Hon'ble Court may be pleased to issue such other relief or reliefs as this Hon'ble Court deems fit, in the interest of justice, in the Petitioner's case.” 3. The grievance of the petitioner is that the appeals filed by the petitioner for the assessment year 2017-18 and 2019-20 on 13.10.2024, are yet to be decided. - 3 - HC-KAR NC: 2025:KHC:23772 WP No. 17589 of 2025 4. I am of the considered opinion that no direction can be issued to the respondents for expeditious disposal of the appeals which have been filed only in the month of October, 2024. Insofar as the interim reliefs sought for in the present matter are concerned, no such reliefs have been prayed in the appeal proceedings. Hence, the question of the petitioner praying the said interim reliefs before this Court in the writ petition seeking for mandamus for expeditious disposal would not arise. 5. In that view of the matter, I pass the following: ORDER a) The writ petition is disposed of. b) Liberty is reserved to the petitioner to seek for such interim reliefs before the Appellate Authority as are permissible in law.
