JUSTICE SOUMITRA SAIKIA ORDER 18.02.2026 Heard Ms. S Yasmin, learned counsel for the petitioner. Also heard Mr. KL Gupta, learned counsel for the respondents. This Court by order dated 21.01.2026 proposed the name of Hon’ble Mr. Page No.# 2/3 Justice HN Sarma, retired Judge of the Gauhati High Court as an prospective sole Arbitrator to adjudicate the disputes and differences arriving by and between the parties due to the Contract Agreement dated 14.12.2021 for construction of (G+8) BPO Tower, Steel Building at Tech City, Bongora, Kamrup, Assam on an amount of Rs.135,88,87,602/- subject to his furnishing of the declaration under Section 12 (1) (b) of the Arbitration and Conciliation Act, 1996. Pursuant to the order passed and a copy thereof being placed before the learned prospective Arbitrator, by communication dated 11.02.2026 the written declaration under Section 12(1)(b) of the Act has been furnished by the learned prospective Arbitrator. Upon due perusal, it is seen that the learned Arbitrator has declared that he has no objection to arbitrate on the dispute and has no past or present relationship with any of the parties nor are there any circumstances which may be likely to affect his ability to devote sufficient time. Learned counsel for the parties submits that in view of the declaration of the learned prospective Arbitrator appointment be confirmed and a date be fixed to appear before the learned Arbitrator. Under such circumstances, since the declaration under Section 12 (1)(b) of the Act has been duly filed by the learned prospective Arbitrator, the appointment of Page No.# 3/3 the learned prospective Arbitrator by the order dated 21.01.2026 is hereby confirmed. Hon’ble Mr. Justice HN Sarma, retired Judge of the Gauhati High Court will act as a sole Arbitrator to decide on the disputes arising by and between the parties pursuant to Contract Agreement dated 14.12.2021 for construction of (G+8) BPO Tower, Steel Building at Tech City, Bongora, Kamrup, Assam on an amount of Rs.135,88,87,602/-. Accordingly, without fail, both the parties are directed to present themselves before the Arbitrator appointed by this Court on 14.03.2026. A copy of this order be placed before the learned Arbitrator by the Registry. The parties will also place a copy of this order before the learned Arbitrator and thereafter, the learned Arbitrator will initiate the proceeding.
