The present petition has been filed seeking a direction to respondent No. 2, the Sub Division Magistrate, Tehsil Gola, District Gorakhpur,, to decide Case No. 3479 of 2024 (Computerized Case No. T202405310703479) [Hemant Kumar Vs. Arun Kumar and Others], under Section 116 of the U.P. Revenue Code, 2006, within a stipulated time period. Learned counsel for the petitioner has referred to the the order sheet of the case, a copy whereof has been appended to the writ petition to point out that although several dates have been fixed, but the matter is being adjourned for some reason or the other and the delay in disposal of the case is causing undue hardship to the petitioner. Accordingly, a prayer for expediting the proceedings is made. Learned Standing Counsel appearing for the State-Respondent(s) and the counsel appearing for the respondent-Gram Sabha, have no objection to the prayer for expeditious disposal of the case. Having regard to the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the present petition is disposed of with an observation that the court concerned would make an endeavor to decide the aforesaid case, in accordance with law, expeditiously preferably within a period of six months from the date of production of certified copy of the instant order, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
