2 bail application of the applicant with the assistance of the State counsel. 3. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 358/2024 registered at Police Station Gandhinagar, District Surguja (C.G.) for the offence punishable under Section 22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 4. Case of the prosecution, in brief, is that as per secret information received form the informant, the Police of Police Station Gandhinagar, District Surguja (C.G.) seized 25 pieces of Talgesic Buprenorphine injuection IP (each containing 2 ml) total 50 ml and 25 pieces of Avil Pheniramine Malete injection IP (each containing 10 ml) and total 250 ml from the possession of the applicant, thereafter, aforesaid offence has been registered against the applicant and subsequently, he was arrested. Hence, the bail application. 5. Learned State counsel opposes the bail application and submits that from the possession of applicant contraband articles i.e. 25 pieces of Talgesic Buprenorphine injuection IP (each containing 2 ml) total 50 ml and 25 pieces of Avil Pheniramine Malete injection IP (each containing 10 ml) and total 250 ml has been recovered, which is much above the commercial quantity, as such, he is not entitled for grant of bail. 6. I have perused the case diary. 3

From perusal of the case diary, it transpires that the article which has been seized from the possession of the applicant is much above the commercial quantity, further the applicant has failed to give explanation regarding the same and it cannot be a case of false implication, the trial is in progress. 8. Accordingly, the bail application of the applicant-Nikku @ Bhargav Jaiswal, involved in Crime No. 358/2024 registered at Police Station Gandhinagar, District Surguja (C.G.) for the offence punishable under Section 22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 9.
Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
