Pursuant to the order dated 28.08.2025, the status report has been received from which it appears that the appellant had surrendered before the learned trial court and was enlarged on bail and subsequent thereto the trial proceeded and at the time of recording of the statement of the accused under Section 313 Cr.P.C the opposite party no.2 once again absconded and his bail bond was cancelled and a non-bailable warrant of arrest has been issued against him for securing his presence. In view of the conduct of the opposite party no.2 as depicted in the status report as well as the fact that the trial is on the verge of closure, I am not inclined to accede to the prayer made by the petitioner in this application and consequently the same stands disposed of.
