The present application under Section 528 of BNSS, 2023 has been filed with a prayer to quash the order dated 23.01.2025, passed by Special Judge SC/ST (Prevention of Atrocities) Act, Ghazipur, whereby an application under Section 175 (3) of B.N.S.S. [156 (3) Cr.P.C.] has been dismissed. After some arguments, learned counsel for the applicant does not want to press the application and wants liberty to file a appropriate application before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
