ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus declaring the action of the respondents No.3 and 4 in receiving the complaint and challenging the competency of the mother in registering a complaint on behalf of my daughter on mental , physical and emotional harassment and repeated acts of cruelty by the way of threat, dowry demand and fixing cameras in a relationship area is as Arbitrary, Illegal, Violation of Natural Justice and violation of Articles 14 and 21 of the Constitution of India and violation of Sec.154 (3) of CrPC and consequently direct the respondent No.3 to register the petitioner complaint dated 14.07.2025 as mother is competent to lodge a complaint on behalf of her daughter and investigate the same in accordance with law.”
2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, the daughter of the Petitioner and Respondent No.6, who is the son-in-law of the Petitioner have matrimonial disputes.
It is further submitted that, when the Petitioner herein lodged a complaint dated 14.07.2024 with the Police, since the couple is in USA, the SHO, Penamaluru Police Station advised the Petitioner to approach the Police at USA and have not registered the complaint submitted by the Petitioner herein. 3. Sri D.Kishore Kumar, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioner to work out her remedies before appropriate forum. There shall be no order as to costs.
