ORDER
This Contempt Case is filed against the respondents for wilful disobedience of the order, dated 18.08.2022 passed by this Court in W.P.No.25903 of 2022. 2. Today, when the matter is taken up for hearing, learned counsel for the respondents has furnished a copy of the proceedings issued by the 3rd
respondent, dated 30.09.2022. Relevant paragraphs of the said proceedings read as follows:-
“ The Hon’ble High Court of AP issued orders as “Liberty is given to the petitioner to submit his representation afresh to the 3rd respondent i.e, The Commissioner, APVVP seeking promotion to the post of Dietician within 15 days from the date of issue of orders” on 18.08.2022. This office received afresh representation from Sri D.Damu, Junior Analyst dated 01.09.2022 and 02.09.2022. During that time, the 3 dietician posts at DH, Rajamundry, DH, Eluru and DH, Machilipatnam suppressed vide G.O.Ms.No.150 HM & FW(A1) Department dated 28.06.2022 out of 5 regular posts sanctioned. One post is filled on contract basis at DH, Telani and one post is vacant at DH, Chittoor which is run by APPOLO private Ltd.,
One Dietician is appointed on regular basis at DH, Machilipatnam is to be adjusted in the vacancy of Dietician at DH, Chittoor. Hence there is no vacancy of Dietician post in entire state to process the promotion file of Dietician. In view of the above it is informed that the request of N.Damu, Junior Analyst is not feasible to consider”. 3. Basing on the said instructions, learned counsel for the respondents submits that as the respondents have complied with the order of this Court, dated 18.08.2022 passed in W.P.No.25903 of 2022, the Contempt Case may be closed. 4. Recording the above submission, the Contempt Case is closed. However, liberty is given to the petitioner to challenge the rejection order
passed by the respondents if he is so aggrieved. There shall be no order as to costs. 5. As a sequel, miscellaneous applications pending, if any, shall stand dismissed. __________________________ Dr.
