The petitioners have been made accused in connection with Meral P.S. Case No.64 of 2020 (S.T. No. 353 of 2021 and G.R. No.2087 of 2021(S) for the offences registered under Sections 452/ 341/ 323/ 307/ 376(D) of the I.P.C., pending in the Court of learned District and Sessions Judge-v, Garhwa. On 06.04.2020 at about 11:30 P.M., the petitioners along with co- accused persons entered into house of the informant. They caught hold of her husband and thereafter, gang raped her. Learned counsel for the petitioners submitted that similarly situated co-accused persons have been granted bail by a Co-ordinate Bench of this Court. It was further submitted that there is land dispute between the parties. Considering the nature of allegation, I am not inclined to release the petitioners, on bail.
