Mr. Romesh Verma, Sr. Advocate, with Mr. Digvijay S. Bisht, Advocate, for the respondent. CMP(M) No. 210 of 2025 No reply is intended to be filed on behalf of the non- applicant. The non-applicant has no objections, if in case, the application is allowed. The sole appellant is stated to have died on 24.1.2023. The said fact is evident from the death certificate appended alongwith the present application. From a perusal of the same, a copy of the Will dated 03.09.2020 appended alongwith executed by the deceased sole appellant, it is evident that the entire immovable property of the sole appellant has been bequeathed by the present applicant i.e. Prem Singh. The right to sue survives in the said legal heir of sole appellant. For the sufficient cause shown in the application, the delay in bringing on record the legal heir of deceased sole appellant is condoned. Abatement, if any, is set aside subject all just exceptions.
