This application has been filed seeking extension of time of mandate of Arbitration Case pertaining to CA No.CE CHZ/SHJ-10/2007-08: Provision of OTM ACCN (RC) at Jutogh: M/s Ancient Infra-Tech Pvt. Ltd., Old name M/s Shambhavi Contractor (Pvt.) Ltd. in Arb. Case No.59 of 2019, titled as M/s Ancient Infra-Tech Pvt. Ltd. vs. Union of India.
2. Mr. Balram Sharma, learned Deputy Solicitor General of India submits that he has no objection for extending time for mandate of the said Arbitrator.
3. In the application, it has been averred that on earlier occasion, this Court allowed extension of time on 20.09.2024 till 17.12.2024. It has been further averred that as per the letter dated 02.11.2024 (Annexure A-1) received from the Arbitrator, the sole Arbitrator sought extension on account of the fact that he has to visit USA from 06.11.2024 till 31.03.2025 due to some medical emergency in family.
4. Perusal of the said communication also go on to show that timeline for final submission has been fixed for
30.10.2024, but the Union of India has not submitted the summary sheet of final bills and written arguments. Similarly, the claimant/applicant has failed to submit written arguments, stamp paper and arbitration fees.
5. The initial appointment was made on 11.12.2020 and since the arbitration proceeding is at fag end, therefore, this Court deems it fit to allow the application and extend the mandate of the Arbitrator till 31.07.2025.
