Julius Riamei, learned counsel on record for the three revision petitioners and Mr. Serto T. Kom, learned counsel for the sole respondent, are before this Court. Learned counsel for the revision petitioners, submits that captioned the CRP arises out of an interim order in a civil suit but pending CRP the main civil suit itself has been dismissed for default/non prosecution on 26.05.2025 and therefore, the captioned CRP has become infructuous. Page 2 In the light of the fair submission of learned counsel for revision petitioners, captioned CRP is disposed of as closed, the same having become infructuous. Though obvious this Court makes it clear that no opinion or view has been expressed on the merits of the matter which means that if the suit is restored, all questions are left open (including questions pertaining to the interim order out of which the captioned CRP arises) and for this purpose all rights and contentions of both sides are preserved. In other words, this order will neither impede nor serve as an impetuous if the suit is revived/restored in the Trial Court.
Page 3 Captioned CRP disposed of as closed albeit with aforementioned observation and preservation of rights in the aforesaid manner. There shall be no order as to costs.
