At the outset, it has been apprised by the counsel for the parties that prior to filing the instant petition, the appropriate Government has already referred the matter, for adjudication of industrial dispute raised by the petitioner- workman, before the Labour Court. Counsel submit that these facts were not brought on the record at the time of filing of the instant petition. Counsel submit that during pendency of this petition, the reference has been decided against the workman, hence, under the changed circumstances, no cause of action survives with the petitioner to continue with the instant petition. Counsel for the petitioner submits that a liberty be granted to the petitioner-workman to assail the order passed by the Labour Court on the reference made by the appropriate Government. 3.
