Both these bail applications arise out of same police case. Accordingly, they are being disposed of by a common order. Petitioners have been made an accused in connection with Koderma P.S. Case No. 141/2024, registered under Sections 302/34 of the Indian Penal Code, Section 27 of the Arms Act, pending in the Court of learned C.J.M, Koderma. On 22.06.2024, unknown persons came to the hotel of the informant and shot his staff Md. Nasim Iraki and Md Anjar Alam due to which both of them succumbed to their injuries. It was submitted that there is specific allegation that co- accused had fired upon the deceased persons due to which they died. It was further submitted that similarly situated co-accused has been granted bail by this court vide B.A. No. 9625/2024. Learned A.P.P.s have opposed the prayer for bail and submitted that the petitioners were present at the place of occurrence. It was further submitted that the petitioners have got no criminal antecedent. Regard being had to the facts and circumstance of the case and considering the fact that co-accused Gulshan Kumar has been granted bail by this court and the case of the petitioners stands on similar footing, the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned C.J.M, Koderma in connection with Koderma P.S.
