Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has primarily prayed for the following relief:- “i. That any appropriate Writ/Order or direction may kindly be issued in favour of petitioner and petitioner may kindly be adjusted nearer to his native place i.e. Regional Hospital Kullu, Block Jarri, CHC Gadsa, PHC Neal (block jarri) keeping in view the ill-heath of the petitioner and adverse family circumstances in the interest of justice and fair play.” 2. When the case was taken up on 18.12.2024, the 1Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:121 following order was passed:- “By way of this writ petition, the petitioner has approached this Court for his adjustment at a station, near to his native place, in lieu of his critical ill health. Having heard learned counsel for the petitioner and having perused the medical record of the petitioner, this Court is of the considered view that it would be in the interest of justice, in case, the petitioner is posted at a station, which is near to his native place and from where he can also access to the medical facilities. Learned Additional Advocate General is directed to have positive instructions qua the adjustment of the petitioner, in light of the prayer made in the writ petition. List on 24.12.2024, as prayed for.” 3. Thereafter, on 24.12.2024, the following order was passed:- “When the case was taken up for consideration today, learned counsel for the petitioner submits that as per his instructions, the post of District Programme Officer (DPO) is lying vacant in the Regional Hospital, Kullu. Learned Additional Advocate General submits that he may be granted some time to have instructions. As prayed for, list on 30.12.2024.” 3 2025:HHC:121 4. Today, learned Additional Advocate General has placed on record instruction dated 31.12.2024, along-with which a notification/officer order stands appended, in terms whereof the petitioner now stands adjusted by way of transfer as a District Program Officer in the office of Chief Medical Officer, Kullu, on medical grounds, with immediate effect, in the public interest. 5. In the light of said notification, as now the grievance of the petitioner stands redressed, these proceedings are closed, with the observation that the petitioner be allowed to serve at the said station for a normal tenure.
