Hon’ble Ashish Naithani, J. (1) Mr. Shariq Khurshik, learned counsel for the petitioners. (2) Mr. R.K. Joshi, learned Brief Holder for the State of Uttarakhand. (3) Petitioners have approached this Court for protection. According to them, they were in love and got married on 14.02.2025 at Arya Samaj Mandir in District Bijnor, as per Hindu rites and rituals. It is contended that father & other family members of petitioner no. 1 are unhappy with their marriage and they are extending threat to the petitioners. (4) Learned State Counsel points out that petitioners are resident of District Bijnor (Uttar Pradesh), therefore, the writ petition ought to have been filed in the State of Uttar Pradesh. (5) Learned counsel for the petitioners, however, submits that respondent no. 2 is employed at Roorkee, District Haridwar & petitioner no. 1 is also residing with him at Haridwar, therefore, the protection would be needed by them at Haridwar, and not at Bijnor. (6) Annexure 2 is the transfer certificate alleged to have been issued in favour of petitioner no. 1 by Head Master, Government Primary School, Bijnor, in which her date of birth is recorded as 21.01.2007. 2025:UHC:1357-DB (7) Having regard to the facts and circumstances of the case, the writ petition is disposed of by permitting the petitioners to approach Station House Officer, P.S. Bhadrabad, District Haridwar for protection and if petitioners make formal application for protection, SHO concerned shall take decision thereupon, as per law, within one week. Till decision on the application, to be submitted by the petitioners, they shall be provided protection.
