The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, has been filed to quash the entire proceedings of Criminal Case No. 18399 of 2024, (State Vs. Hussain) arising out of Case Crime No. 261 of 2018, under Sections 326-A, 323 of I.P.C., Police Station- Kutubsher, District- Saharanpur, as well as cognizance/ summoning order dated 09.10.2024 pending in the Court of Chief Judicial Magistrate, Saharanpur. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ bail application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
