6. As per the allegations, the offence had taken place in a public transport i.e, a bus and the complainant is stated to be working as a Nurse in All India Institute of Medical Sciences, Bathinda. An argument was raised by learned Senior Counsel for the petitioner that it could have been a result of a misunderstanding with regard to the touch, if any, cannot be accepted at this stage in view of the categorical allegations made against the petitioner by the complainant. It is not a case that the complainant and the petitioner were known to each other at any previous stage or that there was any allegation of mala fide against the complainant but it is a case where the RAKESH KUMAR 2025.03.26 16:38 I attest to the accuracy and authenticity of this
order/judgment
CRM-M-10043-2025 (O&M) -6- allegations were made by a passenger who is a lady without any allegation of any kind of mala fide against her. Not only this, the complainant called the help line No.112 of police immediately and thereafter action was taken against the petitioner. The alleged offence took place at a public place in a public transport. The mere fact that the petitioner was suffering from Locomotive disability to the extent of 40% itself cannot become a ground for grant of anticipatory bail to the petitioner in view of the serious allegations made against the petitioner in this regard.
7. After hearing learned counsel for the parties, this Court is of the considered view that the argument which has been raised by the learned State counsel that considering the allegations against the petitioner and the seriousness of the offence, the custodial interrogation of the petitioner is required for elicitation of truth cannot be ignored and carries weight. Therefore, considering the aforesaid facts and circumstances and particularly the fact that the alleged offence took place at a public place and in a public transport, this Court does not deem it fit and proper to grant anticipatory bail to the petitioner.
8. Consequently, the present petition is dismissed.
9. However, anything observed hereinabove shall not be treated as an expression of opinion on merits of the case and is meant for the purpose of deciding the present petition only. 21.03.2025 (JASGURPREET SINGH PURI) rakesh JUDGE Whether speaking : Yes/No Whether reportable : Yes/No RAKESH KUMAR 2025.03.26 16:38 I attest to the accuracy and authenticity of this
